Najmudin Abu Rabi’ Sulayman bin ‘Abd al-Qawi bin Al-Karim al-Tufi as-Sarsari

passed away 716/1316 in al-Khalil, Palestine

Hanbali faqih.

He was born in the village of Tufa in Iraq and moved to Baghdad in 691, then to Damascus in 704. He visited Egypt and the Haramayn and eventually passed away in al-Khalil. He was accused of being a Shiite, as by Ibn Rajab. However this is denied by some.

At-Tufi is famous for his statement that maslahah must be preferred over ambivalent nass and ijma in matters of mu’amalat, a claim he expounded in his Sharh to Nawawi’s 40 Hadith at the 32th Hadith “Harm may neither be inflicted nor reciprocated in Islam [La Darara wa la Dirar]“.
